Distribution of broadcasting revenues of the 2023/2024 season to meet the reporting obligations set out in Royal Decree-Law 5/2015

In accordance with the provisions of Article 7.1 of Royal Decree-Law 5/2015, of April 30, on urgent measures relating to the commercialisation of audiovisual content exploitation rights of professional football competitions (hereinafter, RD) and, among others, Article 2 of Royal Decree 2/2018, of January 12, which implements it, the Control Body for the management of the audiovisual rights of the National Professional Football League is proceeding to publish “(…) the criteria for distributing audiovisual revenues, the amounts corresponding to each participating entity, and the amounts contributed in compliance with the obligations set forth in Article 6.1. (…)”.

I.- Amounts distributed to each participating entity and those contributed in compliance with the obligations foreseen in article 6.1 RD.[1]

The following tables detail the amounts distributed to each participating entity in the different divisions, as well as the amounts contributed in compliance with the obligations set forth in Article 6.1 of the same Legal Code at the close of the 2023/2024 Season, without prejudice to any possible updates that the Control Body for the management of audiovisual rights may need to make in due course:

*Additionally, it should be recalled that among the obligations applicable to the 2023/2024 Season under Article 6.1 of the RD, subsection (a) stipulates the obligation to allocate 2.5% to a Compensation Fund from which sports entities that, while participating in professional football competition, are relegated to a lower division may benefit. The Clubs/SADs which, at the end of the 2022/2023 season, were relegated and, therefore, were entitled to receive this compensation during the 2023/2024 season were those relegated to Segunda División A, highlighted in the table above with an asterisk (*), and those relegated to the Primera División RFEF [2], which are listed below[3]

Furthermore, for the purposes of verifying compliance with Article 5.5 of the RD, which states that the difference between the clubs and entities with the highest and lowest income may not exceed 3.5 times, both the amounts that may be received from the Compensation Fund provided for in Article 6.1(a) and the income participating entities receive from the exclusive audiovisual rights holders as consideration for any other commercial relationship shall be taken into account. 

II.- Criteria for the distribution of audiovisual revenues

The revenues obtained from the joint exploitation and commercialisation of the audiovisual rights of the National League Championship (LALIGA EA SPORTS and LALIGA HYPERMOTION) have been distributed among the clubs and participating entities in the Primera and Segunda División A in accordance with the criteria established in Article 5 of the RD “Criteria for the distribution of revenues among the participants in the National League Championship”. 

So that: 

1) In accordance with the provisions of Article 5.3.b) 1º of the RD, since the Segunda División A has more than 20 participants (as indicated at the end of that section), the percentages received based on sporting results obtained have been adjusted according to the provisions of the following section of the same Article, respecting the progression based on the results, as evidenced in the following table: 

2) In accordance with Article 5.3.b) 2º of the RD, the percentages distributed to participants in the Primera and Segunda División A based on their social reach have been determined in accordance with the following criteria: one-third is based on revenue from season tickets and average gate receipts over the last five seasons, and the remaining two-thirds is based on their contribution to generating resources from the commercialisation of televised broadcasts. These criteria are applied in accordance with the agreements duly approved by the respective Division Assemblies [4] of each category.

Thus, final provision 5.3. of Royal Decree-Law 15/2020, of April 21, on urgent supplementary measures to support the economy and employment entailed the modification of points a) and c) and the addition of point f). Subsequently, article 3.2. of Royal Decree-Law 15/2021, of July 13, has again modified point (c) of the aforementioned article.

[3] The amount of compensation received by affiliated Clubs/SADs that are relegated, both to the Segunda División A and to the Primera RFEF, is regulated in Book VIII of the General Regulations of LaLiga under the title “Regulations on financial compensation for relegation of affiliated clubs/SADs”, in accordance with the provisions of article 3 of RD 2/2018.

In addition, also applicable for the 2023/2024 Season are the agreements of the Division Assemblies of June 29, 2022 in which, at the proposal of the Controlling Body of April 12, 2022, exceptional social reach criteria were established as a result of the situation caused by Covid.
