Nota de Prensa

JUE 09.10.2014

In the last few hours, the Liga Nacional de Fútbol Profesional has been informed of the judgement of the Administrative Court for Sport (TAD), adopted on Friday 3 October, confirming the penalty imposed on Real Murcia CF SAD by the LFP Social Discipline judge on 7 August, consisting of the club’s relegation from its division.

In its judgement, the TAD has agreed to entirely reject the appeal lodged by Real Murcia CF SAD "against the resolution of the Social Discipline Judge, issued in Proceedings No. 2/2014/15 of 7 August 2014", and, among other penalties, it has imposed the relegation of the club from its division, as a result of its repeated and very serious violations of the Articles of Association of the LFP, as well as an additional fine for the sum of 180,303.63 euros.

The judgement confirms that the actions of the LFP’s disciplinary body were at all times in accordance with the Law, endorsing all of the legal arguments used by the Social Discipline judge for this National League in the judgement, as well as those used by the LFP's legal representatives during the appeal lodged with the TAD.

Thus, the judgement rejects all of the arguments put forward by Real Murcia CF SAD in relation to the lack of material competence and legitimacy of the LFP to initiate and implement the disciplinary proceedings and impose the appropriate penalties on the aforementioned club, noting, in particular, the absence of a violation of the principle of non bis in idem.
