Commercial Court No. 6 of Barcelona upholds the judgment issued in favour of LALIGA, and dismisses the annulments filed by Cloudflare and RootedCON

This decision, against which no appeal may be lodged, constitutes an important legal backing for the legitimate initiatives undertaken by LALIGA and TELEFÓNICA AUDIOVISUAL DIGITAL S.L.U. in the fight against audiovisual fraud and piracy in Spain.

Commercial Court No. 6 of Barcelona has fully dismissed the requests for annulment of proceedings filed by Cloudflare and RootedCON, among others, against the final judgment issued on December 18, 2024, which ordered the blocking of IP addresses used for the unlawful distribution of audiovisual content belonging to LALIGA. This decision, against which no appeal may be lodged, constitutes an important legal backing for the legitimate initiatives undertaken by LALIGA and TELEFÓNICA AUDIOVISUAL DIGITAL S.L.U. in the fight against audiovisual fraud and piracy in Spain.

The decision reaffirms that the action brought is in accordance with the law and is protected by the current legislation regarding intellectual property and information society services, ratifying the validity of the procedure. In fact, it rules out that a "procedural device" has occurred, as suggested by some applicants, and confirms the validity of the procedure followed, disregarding the court order that there is a procedure for indiscriminate blocking, expressly declaring that there was no ‘undermining of guarantees’.

As stated in the order, notified this very morning, “it is not proven, from the arguments made by the various petitioners, that any damage has occurred, nor is such damage identified, nor quantified, nor is the taking of any evidence requested aimed at proving, directly or indirectly, the generation of damage as a constitutive element of the claim for annulment.”

With this decision, the judiciary gives a boost to the strategies for the defense of audiovisual rights developed by LALIGA and TELEFÓNICA AUDIOVISUAL DIGITAL S.L.U., who act within the legal framework to safeguard their content against piracy practices that undermine the sustainability of the sector. This judgment constitutes a new firm step in the consolidation of a fairer and more legal digital environment for creators and rights holders in Spain.
